Airport Employee’s Medical-Depart Swimsuit Will not Fly, Choose Says

Law360 (Mar 17, 2021, 7:32 p.m. EDT) – A former communications officer for two Detroit area airports does not have enough evidence to sustain a lawsuit alleging she was denied boarding and had to resign, because she repeatedly sought medical leave, a Michigan federal judge ruled on Wednesday.

U.S. District Judge Sean Cox approved the Wayne County Airport Authority’s offer for a summary judgment on the Americans with Disabilities Act and Family and Medical Leave Act lawsuits against Heather Rossi. Rossi had argued that her frequent use of FMLA vacations to treat various medical issues led to her forced downgrading and constructive discharge.
