Biden Fires Trump’s US Labor Board’s High Lawyer After His Refusal To Resign

- President Joe Biden fired Peter Robb, general counsel of the National Labor Relations Board (NLRB) after he refused to resign, according to Bloomberg Law.
- “The removal of an incumbent NLRB General Counsel before the end of his term by a President of the United States is unprecedented,” Robb wrote in a letter to the Biden administration received from Bloomberg Law.
- In the past, the NLRB’s General Counsel served their full tenure, even when new administrations took office and were not fired, according to the National Right to Work Foundation.
President Joe Biden took the unprecedented move to sack National Labor Relations Board General Counsel Peter Robb after refusing to resign Wednesday.
President Joe Biden reportedly asked National Labor Relations Board (NLRB) General Counsel Peter Robb to step down at 5 p.m. on Wednesday, just hours after the president took office, according to Bloomberg Law. Robb then sent a damning letter to White House Human Resources Director Cathy Russell, who refused to submit a letter of resignation before being fired on Wednesday night.
“The removal of an incumbent NLRB General Counsel prior to the end of his term by a President of the United States is unprecedented in the creation of the National Labor Relation Act (NLRA) and the NLRB,” wrote Robb’s letter received from Bloomberg Law.
Robb added that a key component of the 1947 NLRA was the creation of an “independent” General Counsel. The NLRB General Counsel is appointed by the President, has a four-year term, and is responsible for investigating and prosecuting unfair labor practices.

In the past, the NLRB’s General Counsel served their full tenure, even when new administrations took office and were not fired, according to the National Right to Work Foundation. Former President Barack Obama’s NLRB General Counsel Richard Griffin served his entire term after Donald Trump took office.
“This unprecedented move to oust NLRB General Counsel Robb before the end of his Senate-approved four-year term is the opposite of a return to ‘normalcy’ and a disturbing sign of how far the Biden Harris administration is ready to go are going to repay the union bosses who helped bring Biden to the White House, “Mark Mix, president of the National Right to Work Foundation, said in a statement.
Mix said the unions welcomed Biden’s dismissal of Robb for supporting ordinary workers’ rights over Big Labor interests. Robb chose workers who did not want their union dues to be used for political contributions and supported rules that made it easier for workers to vote for unions from their place of work.
“In his first few hours in office, President Joe Biden immediately took steps to secure the rights and protect the welfare of working families in America by removing Peter Robb as general counsel of the NLRB,” said the American Federation of Labor and Congress Industrial Organizations (AFL) -CIO) President Richard Trumka said in a statement on Wednesday
“Robb is an anti-union attorney by profession and has relentlessly challenged workers’ right to bargain collectively for over three years,” he continued.
The AFL-CIO is an association of 55 trade unions representing 12.5 million workers.
