Criminal information is just accusation. All accused persons are presumed innocent unless and until they have been found guilty in court.
A judgment after a guilty party has been determined is imposed by the judge taking into account the applicable federal condemnation laws and the federal condemnation guidelines.
The maximum sentence under federal law for this offense is one year imprisonment, a period of supervised release after imprisonment, and a fine. The federal sentencing guidelines also require the judge to consider and weigh a number of factors, including the nature, circumstances, and gravity of the crime. the history and characteristics of the accused; and the need to punish the accused, protect the public, and care for the accused’s educational, professional, and medical needs. For these reasons, the maximum legal penalty for the offense is not an accurate indicator of the possible penalty for a particular defendant.
