Motor Accidents and Staff Compensation Laws Modification Invoice 2021 launched in parliament (NSW)
The 2021 Motor Vehicle Accidents and Workers Compensation Amendment Act was tabled to the Legislative Assembly by the Hon Victor Dominello, Minister for Customer Service.
In his second reading address, Mr. Victor Dominello noted that the changes are aimed at clarifying rights and entitlements and improving the regulation, management and efficiency of compulsory liability insurance (CTP) and employee compensation systems. The bill covers 4 major themes:
- Improving customer experience, system efficiency, fairness and equity.
- Improving access to compensation claims for injured workers, certain volunteers and people injured in motor vehicle accidents and their families.
- Expansion and clarification of existing regulatory powers, including provisions on suspected diseases and point-to-point vehicles.
- Create new powers for the state insurance regulator to allow better regulation for providers of treatment and other services in the workers’ compensation and CTP insurance systems.
The bill includes 4 schedules. Annex 1 provides for changes in relation to motor vehicle accident law. Appendix 2 provides for changes in relation to the Employee Compensation Acts. Appendix 3 contains changes to the State Insurance and Care Governance Act 2015 (NSW) relating to health care providers. Appendix 4 provides amendments to the Personal Injury Commission Act 2020 (NSW) to aid in the establishment of the Personal Injury Commission.
