If a judge has determined that a state trooper named as a defendant in a civil rights lawsuit for handcuffing the plaintiff is entitled to a summary judgment under the doctrine of qualified immunity, the sentence must be overturned and pre-trial detention must be ordered because the plaintiff has a real factual argument about whether state trooper violated their clearly enshrined constitutional right to be free from excessive violence.
