Social media rights are spreading misinformation, falsely claiming that President Joe Biden must provide the State of the Union address, some claiming the February 20 deadline has passed. Their false claims and fact-checking responses made “SOTU” trending on Twitter Thursday afternoon.

The outrage comes the same day that the Acting Capitol Police Chief Yogananda Pittman said right-wing extremists on the House Appropriations Committee, whom they referred to as “militia” members, “have expressed their wishes that they blow up the Capitol and want to kill as many members as possible “the House and Senate” as possible.

House spokeswoman Nancy Pelosi has not yet set a date for a joint conference session. The President does not deliver a State of the Union address in his first year in office.

The February 20 claim, which is false, appears to have originated or was popularized by this Facebook post which initiated a verification of USA Today facts that it was “incorrect information.”

Despite the ignorance of the MAGA crowd and right wingers, the US Constitution is clear and offers few expectations for addressing Congress.

Article II, Paragraph 3, Clause 1 states that the President shall “from time to time provide Congress with information on the state of the Union and recommend measures which he deems necessary and appropriate.”

No date, mode, or even frequency is required. At the beginning of US history, the President wrote a letter to Congress.

Here’s a failed Republican candidate for the U.S. Senate from New Jersey proposing that the constitution require an address from the state of the union. She claims that she is “asking on behalf of the Constitution”.

The President is constitutionally mandated to deliver a speech on the state of the Union at the invitation of the President of the House, which has been held in January / February since 1934.

This year’s #SOTU was listed as TBD.

This MAGAite suggests that President Biden is a “fraud” and “not elected, illegitimate and totally unfit” for not providing an address for the state of the Union.
