Freight Co. Should Face Ex-Employee’s Medical Depart Claims

Law360 (Apr 22, 2021, 1:38 p.m. EDT) – Freight company Unishippers and one of its subsidiaries can’t escape claims by a former worker that she was wrongly dismissed two days after her request for short-term medical leave, a surgery ruled Pennsylvania federal judge.

U.S. District Judge John Gallagher on Wednesday denied dismissal requests from Unishippers Global Logistics LLC and Transource Inc. in former worker Nerian Bracero’s lawsuit under the Family and Medical Leave Act, Americans with Disabilities Act, and state law.

Unishippers, a third-party shipping service provider, argued it was not a party to the lawsuit because Transource, not Unishippers itself, hired Bracero directly. In the meantime, Transource claimed it …
