A Wayne County Airport Authority employee is not entitled to trial over his allegation that he was denied promotion to a training coordinator in retaliation for taking vacation under the Family and Medical Leave Act, a Michigan federal court ruled. His claims that he trained the successful candidate, had seniority, and was told he was a “divider” for the position are insufficient to show that the explanation for his non-selection – the other candidate did better and got higher scores during the interview – pretext, the court said.
